Terms and Conditions

These Terms and Conditions explain the basis on which you may use Going Fishing Directory, including its public information, user accounts and Fishery Owner services.

Going Fishing Directory is operated by Christene Jayne Backhouse, operating as Going Fishing Directory.

By using the Directory, or by creating an account, you agree to these Terms and Conditions.

1. About Going Fishing Directory

Going Fishing Directory is an independent information resource intended to help anglers discover coarse fisheries and find useful information when planning where to fish.

Fishery information may be researched from publicly available sources, supplied or updated by fishery owners and authorised representatives, or maintained by Going Fishing Directory.

Inclusion in the Directory does not constitute an endorsement, recommendation or guarantee of a fishery, its facilities or the fishing available there.

2. Using the Directory

The public areas of Going Fishing Directory are currently available to use without charge or registration.

Some features require a registered account. We may introduce additional optional features or subscription-based services in the future. Any charges and additional terms applying to those services will be made clear before a user chooses to use them.

Going Fishing Directory accounts are for people aged 18 or over. You must be at least 18 years of age to create an account.

3. User Accounts

Anglers may register using a name or name by which they are known, together with a valid email address and any other information reasonably required to operate the account.

Fishery Owners and authorised representatives may be required to provide their full name and additional information necessary to establish their identity and connection with a fishery.

You are responsible for choosing a suitably strong password, keeping your login details secure and taking reasonable steps to prevent unauthorised use of your account.

If you believe that somebody else has gained access to your account, you should contact us as soon as reasonably possible.

4. Fishery Listings

Going Fishing Directory may create and maintain fishery listings using factual information obtained from publicly available sources.

A fishery does not need to request inclusion before factual information about the venue may be considered for publication. However, we will only publish a fishery where we believe there is sufficient useful and reliable information to justify its inclusion.

We retain editorial control over the Directory and may decide whether a fishery or particular information is suitable for publication.

5. Requesting a New Fishery Listing

A Fishery Owner or authorised representative may ask us to consider a fishery for inclusion where it is not already listed.

Before creating the listing, we may ask for information that allows us to identify the fishery, establish the applicant's connection with it and determine whether it is suitable for the Directory.

Owner-requested inclusion is subject to sufficient accurate and appropriate information being provided to create a useful listing. Owners are expected to populate and maintain the principal sections of their listing where those sections are relevant to their fishery.

Submission of a request does not guarantee inclusion, and Going Fishing Directory retains final responsibility for deciding whether a listing meets its publication standards.

6. Claiming a Fishery

A person claiming a fishery must be its owner, operator, manager or another person genuinely authorised to act on its behalf.

We may check information supplied with a claim and undertake reasonable enquiries before granting Owner access. Submission of a claim does not guarantee that it will be accepted.

If management or ownership of a fishery changes, or a person otherwise ceases to be authorised to represent it, their right to manage that fishery through the Directory ends.

7. Owner-Managed Information

Approved Fishery Owners and representatives may maintain information about their fishery through the Owner area.

Information entered into a listing must be accurate, relevant and appropriate to the section in which it is entered.

The Owner area is provided for maintaining useful fishery information. It must not be used to publish unrelated advertising, promote unrelated goods or services, or publish material that is unlawful, misleading, abusive or otherwise inappropriate.

We do not routinely audit every change made by a Fishery Owner. However, where inaccurate, misleading, inappropriate or misplaced information comes to our attention, we may correct, hide or remove it.

Claiming or managing a fishery does not transfer ownership of the Directory listing or remove Going Fishing Directory's editorial and publication control.

8. Accuracy of Fishery Information

We make reasonable efforts to provide accurate and useful information. Fisheries change, however, and prices, opening arrangements, rules, facilities, stocks and other information may change without our knowledge.

We cannot therefore guarantee that every item of information in the Directory is complete or current at all times.

Anglers decide whether to act upon information provided through the Directory. Where information is important to a planned visit, we strongly recommend checking it directly with the fishery before travelling.

If you find information that appears to be incorrect, please let us know so that it can be reviewed.

9. Fishery Rules

Rules shown in the Directory are provided to help anglers prepare for a visit. A fishery may change its rules before those changes are reflected in the Directory.

The fishery's current rules, notices and reasonable instructions always take precedence over information displayed in Going Fishing Directory.

10. Species, Weights and Fishing Advice

Information about fish species, typical weights, recorded weights, catches and seasonal fishing advice is provided for general information and guidance.

Such information does not guarantee the presence, current size or condition of individual fish, nor does it guarantee that an angler will catch any particular species, weight or quantity of fish.

11. Your Safety

Angling and visiting waters can involve hazards. Every angler and visitor is responsible for taking reasonable care of their own safety and for avoiding actions that may put themselves or others in danger.

You should assess conditions at the venue, observe warning signs, remain aware of hazards and follow safety instructions given by the fishery or landowner.

The inclusion of a fishery in Going Fishing Directory does not mean that we have inspected or certified the venue, its banks, platforms, access routes, electrical hazards or other conditions as safe.

12. Bookings, Tickets and Transactions

Going Fishing Directory does not currently sell fishery tickets or make bookings on behalf of fisheries.

Where you purchase a ticket, make a booking or enter into another transaction with a fishery or third party after finding information through the Directory, that transaction is between you and the relevant fishery or third party.

Going Fishing Directory is not a party to that transaction merely because the venue or service was discovered through the Directory.

13. External Websites and Services

The Directory may contain links to fishery websites, social media pages, booking services and other third-party websites.

These links are provided for convenience and additional information. We do not control third-party websites and are not responsible for their availability, content, privacy practices or operation.

14. Requests to Correct or Review a Fishery

Fishery Owners and authorised representatives may ask us to correct, review or remove information about their fishery.

We will consider reasonable requests and will correct information shown to be inaccurate where appropriate evidence is available.

A request to remove an otherwise accurate factual fishery listing does not automatically result in its removal. Going Fishing Directory remains an independent information resource and retains responsibility for decisions about publication.

Requests concerning personal information about an identifiable individual will be considered separately in accordance with applicable data protection law and our Privacy Policy.

15. Removing or Unpublishing Listings

We may unpublish, restrict or remove a fishery listing where we reasonably believe this is appropriate. Reasons may include a fishery closing, insufficient reliable information being available, significant information being incapable of verification, misuse of the Owner service or the listing otherwise failing to meet our publication standards.

16. Content and Intellectual Property

The Going Fishing Directory name and branding, website design, software, original written material and other original content produced for the Directory are protected by applicable intellectual property rights.

Individual facts about fisheries are not claimed as our exclusive property merely because they appear in the Directory.

You may use the Directory for normal personal use, but you must not systematically extract, reproduce or republish substantial parts of the Directory, or use automated systems to create or populate another directory or database from our service, without permission where such activity would infringe our applicable rights.

17. Content Supplied by Fishery Owners

A person supplying original text, photographs or other material retains any rights they hold in that material.

By supplying material for publication, you give Going Fishing Directory permission to store, reproduce, display and publish it as part of the Directory and to make reasonable editorial changes where necessary for presentation, consistency or operation of the service.

You must only upload photographs or other protected material where you own the necessary rights or have appropriate permission to allow Going Fishing Directory to use and publish it.

We may hide or remove material where a credible concern is raised about copyright, ownership, legality or another person's rights while the matter is investigated.

18. Misuse and Account Access

If we believe that an account or Owner service is being misused, we will normally explain the problem and provide a reasonable opportunity for it to be corrected.

Continued or repeated misuse may result in Owner privileges or account access being suspended or withdrawn.

We may restrict access without prior warning where this is reasonably necessary to protect the security or integrity of the Directory, its users or its data. Where appropriate, we will review the restriction once the immediate risk has been addressed.

19. Closing an Account

Registered users may ask for their account to be closed.

Closing an account does not necessarily require the immediate deletion of every associated record. Limited information may be retained where reasonably necessary for security, audit, continuity, legal or legitimate administrative purposes.

Further information about personal information and retention is provided in our Privacy Policy.

20. Availability of the Service

We aim to keep Going Fishing Directory available and operating reliably, but we do not guarantee uninterrupted or error-free access.

We may temporarily suspend parts of the service for maintenance, security, technical work or other reasonable operational reasons. We may also add, change or withdraw features as the Directory develops.

21. Responsibility and Liability

Going Fishing Directory provides information intended to help anglers make informed decisions. It does not make those decisions on an angler's behalf.

Because fishery information can change without our knowledge, we cannot accept responsibility merely because an angler incurs travel costs, loses fishing time or experiences another foreseeable inconvenience after relying on information which has subsequently changed or which we could not reasonably have known was inaccurate.

Nothing in these Terms is intended to exclude or restrict any responsibility or liability which cannot lawfully be excluded or restricted, or any statutory rights that you are entitled to exercise.

22. Changes to These Terms

We may update these Terms as Going Fishing Directory develops or where legal, regulatory, security or operational requirements change.

Where a significant change materially affects registered users, we will make reasonable efforts to bring it to their attention.

The date of the latest revision will be shown on this page.

23. Problems and Disputes

If you have a concern about Going Fishing Directory, please contact us first.

We would prefer to understand the problem and, wherever reasonably possible, work towards a satisfactory outcome for everyone involved before a dispute is escalated.

24. Governing Law

These Terms and Conditions are governed by the laws of England and Wales, subject to any mandatory rights or protections that apply to you under applicable law.
